SC put on hold the implementation of its 1983 Judgement till 2024

Supreme Court on 26 August 2014 put on hold the implementation of its 1983 Judgement till 2024. The judgement was made by the Bench of the judges of Supreme Court comprising Chief Justice of India (CJI) R.M.Lodha, Justices Kurian Joseph and R F Nariman.

SC bench thought it prudent to again defer implementation of the judgment by another 10 years. The reason behind this is the bench of SC does not want to provide the spark to a religious conflagration that has been tamed by time, at least for the last decade.
However, it directed the director general of UP Police to take all necessary steps to ensure peace in Doshipura.

Dispute

Around 136 year ago, there was some land dispute between Shias and Sunnis over eight plots of land with two graves at Doshipura in Varanasi.

Since 1878, Shias and Sunnis in Doshipura have been continuously fighting on the streets and in the courts. The fight continues despite a 1981 SC judgment, which gave Shias complete worship rights and asked Sunnis not to trespass.

In 1983, SC declared the property exclusively of the Shia community and allowed shifting of two graves. It had also ordered construction of a boundary wall around the graves belonging to Sunnis. The 1983 orders were yet to be implemented.
